Terms of Service

These Terms of Service ("Terms") govern your use of the Nintai mobile application (the "App"), operated by Nintai Studios (operated by Gor Barsegian) ("we", "us", "our"). By downloading, accessing, or using the App, you agree to these Terms.

If you do not agree, do not use the App.

1) Who we are

2) Eligibility and minors

The App is available in app stores for broader age ranges, but the content is intended primarily for adults (18+).

If you are under 18, you may use the App only with permission and supervision of a parent/legal guardian. If you are a parent/guardian, you are responsible for the minor’s use of the App.

3) Health & fitness / no medical advice (critical)

The App provides general fitness and nutrition information for educational and informational purposes only.

• We are not a medical provider, personal trainer, dietitian, or healthcare professional.
• Nothing in the App is medical advice, diagnosis, treatment, or a substitute for professional care.
• Always consult a qualified professional before starting any exercise or nutrition program, especially if you have any medical condition, pain, dizziness, or other symptoms.
• You are responsible for exercising within your limits and using safe technique.

You use the App at your own risk. Results can vary and are not guaranteed.

4) Accounts and security

You may need an account to use features.

You agree to:

• provide accurate information (and keep it up to date)
• keep your login credentials confidential
• notify us if you believe your account is compromised

You are responsible for activity under your account unless caused by our breach of these Terms.

5) Subscriptions, trials, and payments

Some features require a paid subscription (including possible free trials).

• Billing and payments are processed by your platform provider (Google Play / Apple App Store) and/or subscription services we use (e.g., RevenueCat).
• We do not store full payment card details.
• Subscriptions auto-renew unless canceled before the renewal date (per your platform settings).
• Deleting your account does not cancel your subscription. You must cancel through Google Play / App Store.
• Refunds (if any) are handled according to the policies of Google Play / Apple App Store.

6) User content (photos, avatars, uploads) + takedown

The App may allow you to upload content ("User Content") such as profile images or photos.

6.1 Your responsibility

You represent that:

• you own the User Content or have the rights/permissions to upload it
• it does not infringe copyrights/trademarks/privacy rights or violate laws
• it is not illegal, abusive, or harmful

6.2 License you give us

You keep ownership of your User Content, but you grant us a worldwide, non-exclusive, royalty-free license to host, store, reproduce, display, and process your User Content only to operate and improve the App (for example: displaying it in your profile, syncing it across devices, backing it up, and allowing you to manage it).

6.3 Removal requests

If a rights holder requests removal, or if we believe content violates these Terms, we may:

• remove or restrict access to User Content, and/or
• suspend or terminate accounts involved.

To report copyright or rights issues, email nintai.app.team@gmail.com with:

• the content in question
• proof of ownership/authority
• what you want removed, and why

7) Acceptable use

You agree not to:

• reverse engineer, decompile, or attempt to extract source code (except where allowed by law)
• bypass paywalls/subscription checks or security
• scrape, overload, disrupt, or interfere with the App
• use the App for illegal activity
• upload malicious code or content that violates rights

8) Intellectual property

The App and all related content (UI, code, text, graphics, logos, workout plans, tutorials, and databases) are owned by us or licensed to us and are protected by intellectual property laws.

You receive a personal, limited, non-exclusive, non-transferable, revocable license to use the App for personal use. You may not copy, redistribute, sell, or create derivative works from the App or its content without our written permission.

Food database and visual content

The App contains a proprietary database of food items, nutritional values, and related visual materials. All food names, nutritional information structures, images, illustrations, and visual representations displayed in the App are either owned by Nintai Studios or lawfully licensed, and are protected as a collective database and content compilation. Unauthorized copying, extraction, reuse, redistribution, or claiming ownership of such content, in whole or in part, is prohibited.

9) Third-party services

The App relies on third-party services (for example Firebase and RevenueCat, plus Google/Apple platform services). Your use of those services may also be governed by their terms and policies.

10) Disclaimers

The App is provided "as is" and "as available." To the maximum extent permitted by law, we disclaim warranties of merchantability, fitness for a particular purpose, and non-infringement.

We do not guarantee:

• uninterrupted or error-free operation
• that content will always be accurate or complete
• that results will meet expectations

11) Limitation of liability

To the maximum extent permitted by law, Nintai Studios will not be liable for indirect, incidental, special, consequential, or punitive damages, or any loss of profits/data arising from your use of the App.

To the extent liability cannot be excluded, our total liability will be limited to the amount you paid (if any) for the App/subscription in the 3 months before the event giving rise to the claim.

12) Indemnity

You agree to defend and indemnify us against claims arising from:

• your misuse of the App
• your User Content
• your violation of these Terms or applicable law

13) Termination

You may stop using the App anytime. We may suspend or terminate access if you violate these Terms or if required to protect the App, users, or legal compliance.

Account deletion removes access, but does not automatically cancel subscriptions (see Section 5).

14) Changes to these Terms

We may update these Terms. The "Last updated" date will change. Continued use after changes means you accept the updated Terms.

15) Governing law

These Terms are governed by the laws of the Republic of Armenia, without regard to conflict of law rules.
